These Terms of Use (the "Terms") constitute a legally binding agreement between you and Careviv Inc. ("Careviv," "we," "us," or "our"), the operator of Careviv websites, applications, services, and related platforms (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.

• Discover healthcare clinics and providers.
• Access educational healthcare and coverage information.
• Understand potential health plan or benefit coverage.
• Access booking links or appointment facilitation tools.
• Participate in rewards, cashback, or promotional programs.
• Access AI-assisted healthcare information tools.
• Receive reminders, notifications, and service updates.

Careviv does not provide medical services

Careviv does not provide medical services, healthcare treatment, or insurance coverage. Careviv may display content provided by healthcare providers, insurance or benefit administrators, or third-party partners. You are responsible for independently verifying provider services, appointment availability, pricing, and insurance or benefit eligibility.

2. No Medical Advice

• Careviv is not a healthcare provider.
• All information available through the Services is provided for informational and convenience purposes only and must not be considered medical advice, diagnosis, or treatment.
• Always seek professional medical advice from a licensed healthcare professional regarding your health.
• Do not use the Services for emergency medical situations. If you believe you are experiencing a medical emergency, call 9-1-1 or go to your nearest emergency department immediately.
• Your use of the Services is at your own risk.

3. No Patient-Provider Relationship

Use of the Services does not create a doctor-patient, therapist-patient, or any healthcare provider relationship between you and Careviv or any provider listed through the Services. Healthcare providers listed through Careviv operate independently. Careviv does not employ, recommend, endorse, or guarantee the services of any healthcare provider.

• Appointment cancellations.
• Provider availability.
• Quality of healthcare services.
• Outcomes of medical treatment.
• Pricing or billing disputes between you and providers.

4. Provider Listings and Search Results

Careviv may provide listings, profiles, or search results of healthcare providers. These listings may be based on information provided by providers, publicly available registration or licensing information, user preferences and search criteria, user reviews or ratings, and sponsored or promotional placements. Careviv does not guarantee the accuracy, completeness, or timeliness of provider information.

• Some providers may pay marketing or subscription fees to be featured on Careviv. Sponsored providers will be labeled accordingly and do not represent endorsements.
• You are solely responsible for choosing your healthcare provider.

5. Coverage and Benefit Information

Careviv may display estimated coverage or benefit information relating to student health plans, extended benefits, or insurance plans. Coverage information is provided for convenience only and may be incomplete, outdated, or inaccurate.

• Careviv is not an insurance company.
• Careviv is not a benefits administrator.
• Careviv is not a licensed insurance broker.
• You must verify coverage, eligibility, and reimbursement directly with your insurance or benefit provider and healthcare provider.

6. Cashback, Rewards, and Promotional Programs

Careviv may offer cashback, referral rewards, or promotional incentives. Participation in these programs is subject to the following:

• Eligibility: Rewards may only be available for qualifying actions, such as completed appointments verified by Careviv or participating partners.
• Verification: Rewards may remain pending until appointment completion or eligibility is confirmed.
• Reversals: Careviv may cancel or reverse rewards if appointments are cancelled or refunded, fraudulent activity is suspected, or program rules are violated.
• Program Changes: Careviv may modify, suspend, or discontinue rewards programs at any time without prior notice.
• Taxes: Users are responsible for any tax obligations associated with rewards or cashback.
• Rewards are provided as promotional incentives and do not constitute payment for selecting any specific healthcare provider.

7. AI Features

Careviv may provide tools powered by artificial intelligence ("AI Features"). AI Features are provided "as is" and may generate inaccurate or incomplete information.

• AI Features do not provide medical advice.
• AI Features must not replace professional healthcare consultation.
• AI output should be independently verified.
• Careviv is not liable for decisions made based on AI output.

8. User Accounts

To access certain Services, you may create a Careviv account. You agree to provide accurate and complete information, maintain account security, and keep login credentials confidential. You are responsible for all activity conducted through your account. Careviv may suspend or terminate accounts that violate these Terms.

9. User Responsibilities

You agree to use the Services only for lawful purposes. You must not provide false or misleading information, attempt to access restricted systems, interfere with platform operations, use automated scraping or data harvesting tools, or post fraudulent reviews or manipulate ratings. Careviv may remove content or restrict access if violations occur.

10. Third-Party Services and Links

Careviv may link to third-party booking systems, clinics, payment platforms, or informational websites. Careviv does not control and is not responsible for third-party services, including appointment scheduling, payment processing, healthcare delivery, or privacy practices. Your interactions with third parties are solely between you and those providers.

11. User Content and Reviews

You may submit reviews, comments, or other content through the Services. By submitting content, you grant Careviv a worldwide, royalty-free license to use, display, and distribute such content. You agree that your content is truthful and based on genuine experience, does not violate privacy or intellectual property rights, and does not contain defamatory or unlawful material. Careviv may moderate or remove content at its discretion.

12. Intellectual Property

All platform content, branding, technology, and software belong to Careviv or its licensors. You may use the Services for personal, non-commercial purposes only. You may not copy, distribute, or commercially exploit Careviv content without written permission.

13. Disclaimers

The Services are provided "as is" and "as available." Careviv makes no guarantees regarding accuracy of content, provider availability, coverage estimates, platform functionality, or appointment outcomes. Careviv does not guarantee uninterrupted or error-free Services.

14. Limitation of Liability

To the fullest extent permitted by Canadian law, Careviv is not liable for indirect, incidental, or consequential damages. Careviv's total liability relating to your use of the Services shall not exceed the greater of CAD $100 or the amount you paid directly to Careviv in the previous six months.

15. Termination

Careviv may suspend or terminate your account if you violate these Terms, fraud or misuse is suspected, or platform security is compromised. Termination may result in removal of account data.

16. Indemnification

You agree to indemnify and hold Careviv harmless from claims arising from your misuse of the Services, violations of these Terms, or infringement of third-party rights.

17. Dispute Resolution

These Terms are governed by the laws of the Province of British Columbia and applicable Canadian federal law. Any disputes shall be resolved in the courts of British Columbia, Canada, unless otherwise required by consumer protection law.

18. Changes to Terms

Careviv may update these Terms periodically. Material updates will be communicated through website notice, email notification, or platform alerts. Continued use of the Services after updates constitutes acceptance.

19. Eligibility

You must be at least 18 years old or have parental/guardian consent to use the Services.
